YourWebWill.com allows you to make the following legal, customized, state-specific estate planning documents for you and your spouse:
- Will -- Your Will:
- Is the legal document which determines who is to receive your property upon your death.
- Designates who should act as guardian for your children.
- Designates who is to be the executor of your estate. Your executor signs the various court and tax documents necessary to settle your estate, determines what assets you own and what liabilities you owe, and makes sure that those assets pass to your beneficiaries as you have indicated in your Will.
- Designates who is to be trustee if all your assets are not to be distributed to your beneficiaries immediately. From the time of your death until your assets are distributed to your beneficiaries, your trustee will take care of investing those assets, make distributions to your beneficiaries as needed and make the final distributions to your beneficiaries as you have specified in your Will.
- Living Will -- If your state allows a Living Will, it:
- Indicates the medical decisions to be made if you are terminally ill.
- May say whether your organs are to be donated.
- Will be different depending on your state of residence. Each state has a different Living Will form; therefore, it is important when you move from one state to another that you create a new Living Will.
- Health Care Power of Attorney Your Health Care Power of Attorney:
- Specifies who will make medical decisions on your behalf if you can't. Many people will select their spouse or another family member to make those medical decisions. If you make no selection, or you don't have a Health Care Power, someone will still make those decisions on your behalf, usually your doctor. Most people feel more comfortable deciding whom they want to make medical decisions for them, rather than having it default to their doctor.
- May determine other actions, such as organ donations.
- Often allows you to make detailed statements concerning how you want your health care administered.
- Will be different depending on your state of residence. Each state has a different Health Care Power form; therefore, it is important when you move from one state to another that you create a new Health Care Power.
- Financial Power of Attorney Your Financial Power of Attorney specifies who will take care of your financial affairs if you are incapable of doing so due to situations such as a stroke, coma or mental incapacity. With a Financial Power of Attorney in place, there is no need for a court to appoint a conservator for you, saving substantial complexity and expense if you become incapacitated.
- Instructions for Signing Your Documents The Instructions for Signing give specific instructions for each of your estate planning documents. It is very important that you carefully follow these instructions to make sure that all of your estate planning documents are signed correctly.
